USA – Current development

On May 27, 2021, the the Secretary of State issued expanded guidelines for obtaining an NIE for travelers from countries affected by the U.S. Travel Ban. As a result of this determination, together with national interest determinations already in place, travelers subject to these proclamations due to their presence in China, Iran, India, Brazil, South Africa, the Schengen area, the United Kingdom, and Ireland, who are seeking to provide vital support or executive direction for critical infrastructure;

those traveling to provide vital support or executive direction for significant economic activity in the United States.

Travelers who support or direct authoritative economic activities in the United States are also now eligible to apply for an NIE, but only under the following conditions:

  • Travel in support of a significant entertainment production that is conducted in the United States and would not take place or continue without the individual involved
  • Travel by specialized technical personnel or experts to install, commission, service, maintain, or provide essential training for vessels, machinery, or other critical equipment required by U.S. and foreign companies in connection with a substantial investment in the United States.
  • Travel by directors, officers, or senior executives to provide strategy and instruction or guidance for U.S. and foreign companies with a substantial investment in the United States.
